These Terms & Conditions ("Terms") govern your use of the Alphiox Learn German mobile application and any related services (collectively, the "App"). The App is operated by NUB Tech ("we", "us", "our"). By installing, signing in to, or using the App, you accept these Terms. If you do not accept them, do not use the App.

1. Eligibility

You must be at least 16 years old to create an account. If you are between 16 and 18, you confirm that a parent or legal guardian is aware of your use of the App and has consented to it. The App is designed for adult learners of German; it is not directed at children under 13.

2. The service

Alphiox Learn German provides:

Telc-format A1 and B1 mock exams covering Hören, Lesen, Sprachbausteine (B1), Schreiben, and Sprechen.
AI-graded feedback on Schreiben and Sprechen sections.
Interactive German lessons, role-play conversations, and a vocabulary trainer.
A token system for taking individual mock exams without a subscription, and a Premium subscription that grants monthly tokens.

Important — Telc disclaimer. Alphiox Learn German is an independent learning app. It is not affiliated with, endorsed by, sponsored by, or certified by telc gGmbH, and any references to "Telc A1", "Telc B1", or related exam formats are used solely to describe practice material. Mock-exam scores generated by the App are AI estimates intended for personal study only — they are not official Telc certificates and confer no formal qualification. To obtain a recognised Telc certificate, you must register for and pass an official Telc examination through telc gGmbH or an authorised exam centre.

3. Accounts & sign-in

You create an account by signing in with Google or Apple. By doing so:

You authorise us to receive your name and email address from the identity provider, used to create your profile.
You are responsible for maintaining the confidentiality of the account and any activity under it.
You must provide accurate information and notify us at alphaexplorer@nubtech.org of any unauthorised use.

4. Subscriptions & the 7-day free trial

The App offers an auto-renewing Premium subscription, available as monthly or yearly billing. New subscribers receive a 7-day free trial on first purchase. The trial converts into a paid subscription automatically at the end of the trial period unless cancelled.

Billing. Subscriptions are billed by Apple App Store (iOS) or Google Play (Android) under your existing store account. Prices are shown in the store at the time of purchase and may vary by region.
Auto-renewal. Your subscription renews automatically for the same period at the then-current price unless you cancel at least 24 hours before the renewal date.
Cancellation. You can cancel at any time from your store account settings (App Store → Subscriptions, or Google Play → Subscriptions). Cancellation takes effect at the end of the current billing period; no partial refunds are given for unused time.
Refunds. Refunds, where available, are handled exclusively by Apple or Google under their respective refund policies. NUB Tech cannot process refunds directly.

5. Token packs (consumable purchases)

You may purchase token packs to take individual mock exams without a subscription. Tokens are consumable digital items: once a token is spent on a mock-exam attempt, it is non-refundable and cannot be reversed. Subject to the platform's consumer-protection rules, all sales of token packs are final.

6. Acceptable use

You agree not to:

Reverse-engineer, decompile, or attempt to extract the source code of the App.
Use the App to harass, abuse, or harm others, or to upload content that is illegal, defamatory, or infringes third-party rights.
Attempt to bypass the token system, manipulate exam results, or interfere with the App's grading.
Resell, sublicense, or commercially redistribute access to the App.

7. Intellectual property

All content within the App — exam questions, audio recordings, lessons, vocabulary, code, branding — is owned by NUB Tech or its licensors and is protected by copyright. We grant you a limited, non-exclusive, non-transferable licence to use the App for your personal, non-commercial language learning.

8. AI grading & limitations

The Schreiben and Sprechen sections are graded by an AI model (Google Vertex AI / Gemini). AI grading is provided as-is and may be inaccurate or inconsistent. Scores and feedback are intended as study aids, not as a definitive evaluation. We make no warranty that the AI grading reflects the result you would receive in an official Telc exam.

9. Speech recognition

The Sprechen section uses speech-to-text on your device. On Android, speech is transcribed via the on-device Vosk model or the system speech recognizer. On iOS, the Apple Speech framework is used. The audio itself is processed locally; only the resulting text transcript is sent to our servers for AI grading. See the Privacy Policy for details.

10. Service availability

We aim to keep the App available 24/7, but we do not guarantee uninterrupted service. We may suspend, modify, or discontinue parts of the App for maintenance, security, or product reasons, with or without notice.

11. Termination

You may stop using the App at any time. You may delete your account directly inside the App via Profile → Delete account; the deletion is permanent and immediate. If you cannot access the in-app option, email alphaexplorer@nubtech.org from your account email and we will perform the deletion on your behalf. We may suspend or terminate your account if you breach these Terms or use the App in a way that harms other users or the service.

12. Disclaimers & liability

The App is provided "as is" and "as available", without warranties of any kind, express or implied. To the maximum extent permitted by applicable law:

NUB Tech is not liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the App.
Our total aggregate liability for any claim relating to the App is limited to the amount you have paid to us in the 12 months preceding the claim.
Nothing in these Terms excludes liability for gross negligence, intentional misconduct, or any other liability that cannot be excluded under applicable law (including under the German Bürgerliches Gesetzbuch).

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced inside the App or by email. Your continued use of the App after the updated Terms take effect constitutes acceptance of the changes.

14. Governing law & jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-laws rules. Mandatory consumer-protection provisions of your country of residence remain unaffected. The place of jurisdiction for disputes is the seat of NUB Tech, to the extent permitted by law.
